Can a neighbor stop me from cutting down trees if they are only half on his property?
I own a fence that I pay personal property tax to the county every year. Trees were recking my fence so I started to cut them down. My neighbor told me to stop cutting them down. The trunk of the trees were only half on his side.

- His trees were trespassing over your property. Unless there was any other way he could make them stop growing over your property (unlikely) then your actions were reasonable. But technically you must throw the limbs back over on his side, or then you could be held liable.

- Your local council can mediate on this issue because it affects so many people in this country. People are very territorial but its best to come to a peaceful solution-not worth going to court over as there will always be bad feeling. Plus it would be very expensive. Legally if any branch or part of a tree intrudes into your garden you can cut the offending part down. Please contact your council about it for advice-and the Citizens advice bureaux. Good luck
- Because half the tree is in your neighbors yard and half in yours you cannot destroy the trees by cutting them down with out his permission, But you can trim back the Branches that are on your property,and ca cut back ant brances that hang down over on to your side of the Fence
- Yes, you were trespassing and destroying his property. You need to arbitrate. In most states you are also in violation of building code for placing a fence on a property line. Most ordinances say fences are to be 18 inches inside. You're pretty much out of luck on the trees otherwise, since they are half on your property and I'm guessing don't know who planted them.
